Indian Men Protest Against Divorce Law Amendment (By Rahul Kumar)

Nearly a thousand men from across India converged in New Delhi to protest against a proposed bill that seeks to provide fifty per cent of a husband's family wealth to the wife in case of divorce. It also seeks to provide a fast divorce to a couple.
Nearly a thousand men from across India converged in New Delhi to protest against a proposed bill that seeks to provide fifty per cent of a husband's family wealth to the wife in case of divorce.
The men, who came from various organisations and NGOs, are protesting against what they call the 'No Fault Divorce Law' which they say allows for a fast divorce even if one of the spouse does not want a divorce. The protesters fear that if the amendments are passed by the Indian Parliament, then most men will become bankrupt.
The biggest grievance of the protesters was that if the man wants divorce, the courts as well as the wife oppose it but if the wife wants one the divorce will be granted.
The proposed law has been given many names by the protesters. It is also called the 'Irretrievable breakdown of marriage' (IrBM) as well as the 'Gold Diggers Law,' as it will enrich women.
The men's rights activists demanded that the Law Ministry should roll back the amendments as the Hindu Marriage Act is gender neutral. They also wanted that children must be given access to both biological parents in case of divorce or separation.
The protesters demanded that the government bring down the cost of litigation for couples in divorce proceedings.

(My View: As long as we can stand united we can make difference. Please come forward without hesitation and help spread the word. Please make sure to read next article, its great suggestion for you all men dealing with brutal divorce laws)

2. Court grants man divorce due to wife's cruelty, desertion

http://www.indianexpress.com/news/court-grants-man-divorce-due-to-wifes-cruelty-desertion/1068692/

A man has been granted divorce by a Delhi court on the ground that he underwent "tremendous" cruelty because of his wife, who deserted him just a month after marriage.
Additional district judge Sujata Kohli dissolved the marriage under the provisions of the Hindu Marriage Act (HMA) saying the relationship between the couple, who stayed together only for a month, seems dead.
"Taking into account the facts, petitioner/husband has succeeded in establishing the grounds of cruelty as well as desertion as under Sec 13(1)(ia) and (ib) of the HMA and there is no other reason under the law on account of which the husband would be denied the relief and as such he is held entitled to decree of divorce on both grounds," the court said.
The court passed the order ex-parte as the woman failed to appear before it despite several opportunities.
The man had sought divorce on the ground he had married the woman in December 2009 and they started living separately just after a month due to his wife's behaviour.
He had alleged that the woman used to quarrel on trivial issues and her family members had also beaten him up when he tried to reach a compromise on the matter with her.
"The respondent would often threaten him that if he compels her to have any physical relations with him, she would spoil his life and that of his family members," the man had said in his petition, adding that his wife deserted him since January 1, 2010 and never came back.
The court said the husband has established that he was subjected to cruelty and was deserted by his wife.
"Taking the statement of the petitioner/husband as it stands, indeed it cannot be doubted that he has undergone tremendous mental as well as even physical cruelty, at the ends of the respondent (wife)," the judge said.

(My View/suggestion: Indian women normally file compaints against men within a year of divorce like physical abuse, torture, dowry etc, mostly as per the suggestions of lawyers who are there to earn money and not the help get justice. All you men, please be pro-active and dont wait until she goes to one court and another and file compalints against you. If you have truth on your side, go ahead and provide the facts. dont be hesitant, male ego will not save your lives. Go ahead and tell the details and file the compalint before she does. if there is real abuse that would have been filed much before divorce proceedings started. Physical abuse cannot be hidden. In completely get it that sometimes women try to make it work as the men do to and in return they suffer. But IF TRUTH is something that prevails and if you know you (men) are truthdul and you have done nothing wrong, then dont be hesitant to hide any physical abuse (like consistent denial for sex, even after you are legally wed). BE PRO-ACTIVE)
